Terms of Use
These Terms govern access to and use of www.kaptivatelife.com. The website provides general information about Kaptivate Life, its founder, mindfulness teaching, advisory work, professional and small-business experience, and executive group leadership.
Effective date: September 21, 2026
Agreement to These Terms
By accessing or using the website, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the website. These Terms govern the public website only. If Kaptivate Life agrees to work with you, you may be asked to sign a separate client, participant, or engagement agreement addressing the particular work, including its scope, fees, responsibilities, confidentiality, cancellation terms, and other applicable conditions. That separate agreement or other clear written confirmation will govern the engagement.
Informational and Educational Purpose
The website is informational and educational. It may describe the founder's background and experience, offer mindfulness practices or reflections, explain areas of advisory work and executive group leadership, and provide ways to contact Kaptivate Life or schedule a conversation. Website content may be changed, withdrawn, or updated at any time.
Mindfulness Teaching and Certification
Kaptivate Life's founder may accurately describe himself as a certified mindfulness meditation teacher and as having completed Jack Kornfield and Tara Brach's Mindfulness Meditation Teacher Certification Program, commonly called MMTCP.
Mindfulness teaching is educational. It is not psychotherapy, counseling, medical care, mental-health treatment, medical or mental-health advice, diagnosis, or a cure for any condition. Kaptivate Life does not provide medical or mental-health services through the website. If you have a physical or mental-health concern, seek assistance from an appropriately qualified professional. If you may be experiencing an emergency, contact emergency services or an appropriate crisis resource; do not rely on this website or its contact form.
References to MMTCP do not represent that the founder attended or graduated from the University of California, Berkeley, holds a degree or academic credential issued by that university, is a Dharma or Buddhist teacher, or is qualified through MMTCP to lead multi-day residential retreats.
Advisory Work and Executive Group Leadership
Kaptivate Life's advisory work and executive group leadership are separate from mindfulness teacher certification. They are based on the founder's professional, executive, and small-business experience. MMTCP does not certify or endorse that work. Kaptivate Life does not describe these services as coaching.
Website material concerning leadership, organizations, or business is general information. It is not legal, tax, accounting, investment, employment, or other regulated professional advice. Consult an appropriately qualified professional about decisions requiring that advice.
No Relationship Created by Website Use
Viewing the website, using the contact form, sending a message, following a scheduling link, or participating in an introductory conversation does not by itself create a client, adviser, teacher-student, fiduciary, confidential, or other professional relationship. Kaptivate Life accepts an engagement only through a separate written agreement or other clear written confirmation.
Do not submit confidential, proprietary, medical, mental-health, financial-account, or similarly sensitive information through the website, contact form, or scheduling notes. Kaptivate Life cannot promise that unsolicited information will be treated as confidential before an appropriate relationship and terms are established.
No Promised Outcomes
People and organizations respond differently to mindfulness practices, advisory input, and group processes. Testimonials, examples, descriptions of possible benefits, or statements about past experience do not guarantee any personal, professional, health, financial, organizational, or business outcome. You remain responsible for your choices, actions, and decisions.
Minors
The website is intended for a general adult audience and is not directed to children under 13. A person who has not reached the age of legal majority where they live should use the contact and scheduling features only with the involvement and permission of a parent or legal guardian.

Unless otherwise stated, Kaptivate Life or its licensors own the website and its original text, recordings, photographs, graphics, downloads, presentation materials, design elements, logos, and other content. Kaptivate Life⢠and associated branding are trademarks or service marks of Kaptivate Life. These Terms do not transfer any ownership rights to you.

Acceptable Use
You may use the website only for lawful purposes. You must not:

Kaptivate Life may restrict or block access when reasonably necessary to protect the website, its users, or legal rights.
Third Party Services and Links
The website uses a third-party contact-form processor and links to a third-party scheduling service. It may also link to social-media pages, certification or alumni information, and other resources. Those services and sites have their own terms and privacy practices. Kaptivate Life does not control their availability, content, security, or independent actions and is not responsible for them except to the extent applicable law provides otherwise. A link does not imply endorsement unless Kaptivate Life expressly says it does.
Website Availability and Disclaimer
Kaptivate Life aims to keep the website useful and accurate, but information may be incomplete, outdated, or contain errors. To the fullest extent permitted by law, the website and its content are provided as available and without warranties of uninterrupted availability, accuracy, fitness for a particular purpose, or noninfringement. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by law, Kaptivate Life and its founder will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from use of, inability to use, or reliance on the website or third-party links. Kaptivate Life is not responsible for decisions made solely in reliance on general website content. Nothing in these Terms excludes or limits liability that applicable law does not allow Kaptivate Life to exclude or limit.
Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes concerning the website or these Terms may be brought in a state or federal court with jurisdiction in New York, except where applicable consumer law gives you the right to proceed elsewhere.
Changes to These Terms
Kaptivate Life may revise these Terms when the website, its practices, or applicable law changes. Revised Terms will be posted with a new effective date and will apply prospectively from that date. If applicable law requires additional notice or consent, Kaptivate Life will provide it.
Severability and Waiver
If a court finds part of these Terms unenforceable, that part will be limited or removed only to the extent necessary, and the remaining Terms will continue in effect. A delay in enforcing a provision is not a waiver of the right to enforce it later.
